Welcome to Focal Point Artistry. By accessing this website (focalpointartistry.com), purchasing products, or booking a workshop, you agree to be bound by the following Terms and Conditions.

These terms apply to all users of the site, including browsers, customers, school administrators, and organizations.

1. Intellectual Property & Copyright

All content on this site—including artwork, images, workshop materials, logos, and text—is the exclusive intellectual property of Jessica Somers / Focal Point Artistry and is protected by Canadian and international copyright laws.

• Purchase does not transfer copyright: Buying an original painting or print does not give you the right to reproduce, scan, or resell copies of that image.

• Educational Use: Schools and organizations booking workshops may use the provided teaching materials for the specific session booked but may not reproduce them for future unauthorized use without written permission.

2. Online Store Terms

A. Product Descriptions & Colors

We strive to display the colors and details of our artwork as accurately as possible. However, we cannot guarantee that your computer monitor’s display of any color will be 100% accurate to the physical print or original piece.

B. Pricing & Availability

• Prices for our products are subject to change without notice.

• We reserve the right to discontinue any product (e.g., limited edition prints) at any time.

C. Shipping & Delivery

• Location: We ship primarily from Northern Ontario. Shipping times may vary based on your location and weather conditions.

• Risk of Loss: Once we hand the package over to the carrier (Canada Post/UPS), responsibility for loss or damage during transit transfers to the carrier. However, if an item arrives damaged, please contact us immediately.

D. Returns & Refunds

• Damaged Items: If your art arrives damaged, please email us at focalpointartistry@gmail.com within 48 hours of delivery with photos of the damage. We will arrange for a replacement or refund.

• Final Sale: Commissioned pieces, original art, and sale items are considered final sale and are non-refundable unless defective.

3. Workshop & Service Terms

A. Booking & Quotes

• Quotes for workshops and murals are valid for 30 days from the date of issuance.

• To secure a booking date, a non-refundable deposit (percentage varies by service) may be required.

B. Cancellations (Workshops & Speaking)

• Client Cancellation: Please provide at least 7 days’ notice if you need to cancel or reschedule a workshop. Cancellations made with less than 48 hours’ notice may forfeit the deposit.

• Weather/Illness: In the event of severe weather (Northern Ontario winters) or illness, Focal Point Artistry reserves the right to reschedule the session to a mutually agreeable date.

C. School & Youth Program Supervision

• Supervision: For all workshops involving youth or students, a teacher or authorized supervisor from your organization must be present at all times. Focal Point Artistry provides the programming/instruction but is not responsible for student discipline or supervision.

4. Commissions & Murals

• Process: Custom commissions require a consultation and a signed agreement outlining the scope, timeline, and cost.

• Approval: For murals and large commissions, clients will be given an opportunity to approve sketches/concepts before final paint application. Changes requested after approval may incur additional fees.

5. Limitation of Liability

In no case shall Focal Point Artistry, its owner, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages arising from your use of our service or products.

6. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Ontario, Canada.
